    Matthias — sophomore slump for sure. Although the best episode of the whole season (in my opinion)was last Monday's “Four Months Ago…” (11/12) and we won't have the detailed data for that airing until tomorrow, but it still won't be anywhere near the levels of the premiere.

    It's not a “sophomore slump,” a lawsuit filed by two nyc artists in a nyc federal court in march 2007 against Tim Kring and NBC for copyright infringement is having a chilling effect on Heroes storylines and it's ratings.
    The judge on this lawsuit is Denise Cote.
    Judge Cote tried Tyco executive Dennis Koslowski, he was sentenced to 25 years in prison in early 2007.

    Poli, please don't take this personally — it's just my opinion…

    I think the ratings are worse because the show hasn't been very good this year. I'd attribute that more to Kring trying to write story arcs around NBC's scheduling and it not producing a good result.

    That some set-designer asserts that Kring based the character Isaac on a real life artist — so what? Isaac was killed off last year. 99.999% of the people who have ever watched Heroes have never even heard of Joann Vara and a fair chunk of them seemingly stopped watching anyway.

    I'm not saying that the storyline sucks isn't a result of legal action — there's no way for me to know for sure and I seriously doubt Mr. Kring will submit to a polygraph test so I can validate my theory that the show's writing wasn't affected by a lawsuit. But as for the ratings, the show just hasn't been as good this year.

    Comparing Kring to Koslowski is beyond ludicrous in my not so humble opinion.

    Everyone that reads any Heroes blogs have read Joann's comments. Her comments are based on her experience in the film and tv industry . Joann has not asserted anything, she told the fans of Heroes the truth.
    and that truth is:
    “a writer can not register an already published work by another artist with the WGA as “their original material”.
    ( that's stealing). Read the WGA guidelines, it's all there.
    Tim Kring claims he's” the creator” and his storylines are “original.”
    please look up the definition of “creator” and” original “in webster's dictionary.

    The NYC artist that can paint the future and uses his painting to stop a catastophic event against two NYC landmark buidings( 9-11-01″The Twins” and Isaac's Nuclear Blast Heroes) before it happens fiction or non-fiction had already been published several years before Tim kring claims he came up with the idea by these artists in Russell simmons one world magazine in July 2001 and the NY DailyNews on August 5, 2004.
    Tim Kring claims in several interviews that he came up with the idea in Oct-Nov 2005.
    He claims he took a long walk with Jeph loeb and everything he pitched to jeph,
    jeph told him”tim it's been done before”.
    Tim pressed his eyes tight and presto! he was able to come up with a new show idea.
    Tim's new idea made Jeph say: Tim, “the artist that can paint the future “,that's never been done before.
    Tim called Jeph back after their long walk and asked,
    “Jeph do you know of any artist that can paint?
    Jeph pointed Tim kring to
    Tim Sales, a comic book artist that couldn't paint, was color blind and needed to refer to a “Goya art book” for artistic inspiration on how to create paintings for a artist that can paint the future on a major network.( this is white affirmative action, because i doubt if a Black or Latino artist could get a job on a major network without having any qualifications , skills or real talent). It's all online , read it.

    Tim Kring went on to put a script together and add art to the script, something that is not done in Hollywood.
    In interviews, all of the actors on Heroes said they were “shocked “to see art with a script and because of this fact they knew the show was going to be very special.

    Tim Kring claims he pitched that script with art to NBC and on the strength of the script with art, NBC bought Heroes.
    Tim's boss at NBC katherine Pope stated in an interview that” Tim's script with art was revolitionary and his writing skills were extraordinary.”( then why is Heroes number 30 in the ratings?).
    after 10 years” Law and Order” is still in the top 10. why? Because the writers can write.

    A quick glance at the lawsuit files clearly shows the cover of Tim's script with art looks just like “The Twins' script with art. ( both are online).

    A artist that can paint the future is a common stock element. what a writer adds to that common stock element is called an 'expression”. That expression is copyrightable.
    one of the expression in this lawsuit that was stolen is:
    “the NYC artist uses the paintings to stop a tragedy against two NYC landmark buildings.
    Here's the problem:
    That storyline has never been done in tv, film, books or comic books. Name the actor, the show and year. You can't. that's why the storyline was greenlighted by Jeph loeb. ( google tim Kring and jeph Loeb Heroes interviews to read full articles).
    Had Isaac Mendez used his paintings to tell the public which plants in the flower shop will die there would be no lawsuit and no copyright infringement.

    You're right, Isaac was killed off. He was killed off as soon as the lawsuit was filed. ( do the timeline).
    Isaac was the map of the show, that's why his paintings are sill being used in season 2.
    Issac was the reason NBC bought the show, because he was a pioneering character.
    the other chracters are common stock element that can be found in any superhero comic book. but no writer has developed a full character storyline for a ” artist that can paint the future” for a major network.
    Even the actor that played Isaac said in an interview that” I leave Heroes knowing nothing about Isaac.”
    That's not the case with the other characters on Heroes. In fact Tim Kring is making every attempt to tell us about every Hero on the show except Isaac.

    It doesn't matter what joann or any poster think, it's about the facts and what's in the lawsuit files on both sides. i have read both and i'm working on a documentary about this heinous crime. Tim kring lied to and duped a lot of people into thinking he's something he's not and I think the ratings and storylines reflect the level of his talent inspite of any network schedules or lawsuits. Tim Kring is on line for the writer's strike marching for the rights to get top dollar for the work he steals. well for hardworking production people that have to feed their families knowing the truth about this thief hack writer would be a hard pill to swallow. The man is scum and you're not feeling his crime because he's not a young Black male with a gun in his hand stealing your personal belongings.
    You would want that Black man too submit to more than a polygraph, you'd want him in jail where he would rightfully belong.
    It is not up to Tim Kring if “he will or want “to submit to a polygraph, it's up to the judge.

    Read the NY Daily News article in August 2004 “The Twins were living out “Heroes” synopsis:
    “ordinary people with extraordinary powers”, that claim they can paint and write the future.”
    In “The Twins” work online one can read how “The Twins' bleed a liquid from their eyes and have the ability to do so to others.
    In the book Latino's call “The Twins” “Gemelos” through out the work. On Heroes a latino woman called the wonderless twins “Gemelos”.
    “Gemelos” is spanish for twins.
    “The Twins” in their fictional book that's posted online, use their powers to help immigrants across the borders, in Heroes the wonderless twins are immigrants trying to get across the border.

    Robert had Tim Kring stole your work and someone had brought it to my attention the way joann and many other posters have, I would post and let as many people as i could, know about your plight.
    I don't have to know you, you're a human being.
    It's not right to steal and I know you wouldn't appreciate it if someone stole something from you.

    I used to be a fan of Heroes, I used to spend my money to throw “Heroes office parties” and I had no clue about any of this.
    I'm thankful to all the people that posted, it gave me the idea to make my documentary and thanks to myspace, youtube etc… my doc idea is generating interest.
    Tim Kring lied to everyone and my documentary is going to show you the truth about why “Heroes” is no longer number one but number 30 and so much more.

    Question Robert: What will you say or think if it's proven that Tim Kring stole these artists work?

    It was great chatting with you and I very much appreciated your “civil and intelligent ” comments about this lawsuit.
    Here's something I found on “The Twins” artwork spoken about in the NY DailyNews.
    “The Twins” painted and copyrighted a painting called “The Atta Page” in early 2001.
    They left Texas in Jan 2001 enroute to NYC to use “The Atta Page” to stop 9-11-01 before it happened.
    The Atta Page according to what's been posted online, is a large oil canvas that depicts” two airplanes crashing into the twin towers, with the message “a man named ATTA attack twin towers September 11 at 9:00 am.
    The Atta Page also depicts the message that there are 9 letters in the word Manhattan and 11 letters in the name Mohamed Atta.
    The name ATTA is also in the word manhATTAn.
    note: Mohamed Atta was the first pilot to crash a stolen airplane into the twin towers on september 11, 2001.

    according to a screening held at a college for “The Twins”, these artists claim that ATTA WAS SENT because whenever the world looks at the word manhATTAn, the world will always remember the name ATTA and what he did to the twin towers on SEPTEMBER 11,2001.

    Now Robert did you see any of this? I didn't, not until i read the comments online.
    “The Twins' 9-11-01 storyline and their ATTA PAGE is better than any storyline on Heroes.
    Just my opinion…

    and remember, comic book artists in real life don't paint on canvas.

    The Twins not only paint on large canvas, but according to comments online they exhibit their work at major NYC galleries and their art and 9-11-01 story is part of the NY Historical Society's archives, under “CityLore” curated by Sally Herships.
    A story was written in the Boston Globe newspaper about Sally Herships and her experience with “The Twins”.

    There is another article in the Hunter college newspaper “The Envoy” date: May 11, 2005 where “The Twins” predicted and painted Hurricane” Katrina and Rita” that hit in August 2005.
    That's right Robert,
    “The Twins”predictions and paintings for these storms that hit in august 2005 were published in the Hunter College NYC newspaper MAY 11.2005.
    All of this information and more will be in my Documentary.

    The Atta Page also depicts the message that there are 9 letters in the word Manhattan and 11 letters in the name Mohamed Atta.
    The name ATTA is also in the word manhATTAn.
    note: Mohamed Atta was the first pilot to crash a stolen airplane into the twin towers on september 11, 2001.

    according to a screening held at a college for “The Twins”, these artists claim that ATTA WAS SENT because whenever the world looks at the word manhATTAn, the world will always remember the name ATTA and what he did to the twin towers on SEPTEMBER 11,2001.

    The Twins not only paint on large canvas, but according to comments online they exhibit their work at major NYC galleries and their art and 9-11-01 story is part of the NY Historical Society’s archives, under “CityLore” curated by Sally Herships.
    A story was written in the Boston Globe newspaper about Sally Herships and her experience with “The Twins”.

    There is another article in the Hunter college newspaper “The Envoy” date: May 11, 2005 where “The Twins” predicted and painted Hurricane” Katrina and Rita” that hit in August 2005.
