Though LOST at 10pm gets much more same day viewing at 10pm than CSI: Miami. Still, LOST did drop into the 40% range when it moved from 9pm to 10pm. Most of the shows on the list run before the late time slot. I know when House was on Tuesdays I would record it and watch it at 9 (Central) because there was nothing else to watch at 9. So CSI Miami is probably doing well to be on the list. Of course you wouldn't watch CSI Miami the same night. It is on a Monday, just before the evening news in most places.
