    I was too when John Kerry said those EXACT words to me yesterday during his Senate Foreign Relations Committee Confirmation Hearing for Secretary of State.

    As I told John Kerry, “the Constitution has no exception for when you’re having a tough time or when people disagree with you.”

    But that’s not all I had to say.

    Unfortunately, that’s the problem in Washington these days.

    Too many politicians and bureaucrats flat-out ignore the Constitution, or they think they have the authority to obey it at will.

    There’s no accountability.

    Hillary Clinton acted the same way during her hearing over the Benghazi terrorist attacks that left four Americans dead.

    And to add insult to injury, whenever concerned Americans like you hold their feet to the fire and expect them to fulfill the duties their offices demand – they’re outraged.

    Rest assured, I’m going to hold their feet to the fire.

    Whether they like it or not, whenever the Big Government crowd decides to cherry-pick the Constitution, I’m going to call them out on it.

    That’s because I’m dead serious about restoring constitutional government in America.

    Federal Appeals Court Tells Obama He Violated the Constitution and Abused Power

    RUSH: A federal appeals court has ruled that President Obama violated the Constitution when he bypassed the Senate to fill vacancies on the National Labor Relations Board. This is the US Court of Appeals for the DC circuit. It said that Obama did not have the power to make recess appointments earlier this year to the NLRB. The Senate was not in recess. I’ll never forget this. The Senate wasn’t in recess and he made recess appointments.

    Well, there’s this thing called the Constitution. Now, the president said that he acted properly because the Senate was away for the holidays. That may have been, but they were not shut down. The court says that the Senate technically stayed in session when lawmakers gaveled in and out every few days for so-called pro forma session. I remember this quite well. I forget the specific reason, but there was a reason why they didn’t, the Senate — Harry Reid was playing games.

    So congratulations to Landmark Legal Foundation. As you know it’s headed up by our good buddy here, Mark F. “Lee” Levin. It’s a major, major statement for the DC circuit to essentially tell the president of the United States that he has abused his power, he does not have this kind of power.

    “A three judge panel for the U.S. Court of Appeals for the District of Columbia Circuit today adopted arguments advanced by Landmark Legal Foundation to overturn appointments made by President Obama to the National Labor Relations Board (NLRB). Landmark argued in its amicus curiae (friend of the court) brief that the President’s use of the Constitution’s “recess appointments” clause violated the restrictions placed by the Constitution on that power.”

    Court Rules Obama NLRB Appointments Unconstitutional

    President Obama’s recess appointments to the National Labor Relations Board violated the Constitution, a federal court of appeals ruled today, also raising questions about Obama’s pick for head of the Consumer Financial Protection Board.

    The court called the appointment of three members to the National Labor Relations Board in January 2012

    “an unconstitutional act,” because it took place when the Senate was in an “intrasession” recess, rather than an “intersession” recess.

    President Obama appointed Richard Cordray to be head of the CFPB at the same time.

    The recess was considered intrasession because of pro-forma sessions that Republican senators held during the Senate’s recess that month. Washington College of Law Professor Stephen Vladeck characterized those sessions as “congressional dysfunction and congressional obstructionism,” as they prevented the president from making his pick for those positions.

    In 2007, Harry Reid started holding pro-forma Senate sessions to prevent George Bush from naming recess appointments. (Source- CNN from 2007)

    Last year when Republicans did the same, Obama named them anyway. This ruling invalidates Obama’s appointments.(Source- The Hill) [End Update]

    A federal appeals court has ruled that Barack Obama abused his powers when he made recess appointments last year when the Senate was technically not in recess, making those appointments unconstitutional and illegal.

    RULING by Court

    1. It is undisputed that the Board must have a quorum of three in order to take action. It is further undisputed that a quorum of three did not exist on the date of the order under review unless the three disputed members (or at least one of them) were validly appointed. It is further agreed that the members of the Board are “Officers of the United States” within the meaning of the Appointments Clause of the Constitution,which provides that the President “shall nominate, and by and with the Advice and Consent of the Senate, shall appoint Ambassadors, other public Ministers and Consuls, Judges of thesupreme Court, and all other Officers of the United States,whose Appointments are not herein otherwise provided for, and which shall be established by Law.” U.S. Const. art. II, § 2, cl.

    2. Finally, it is undisputed that the purported appointments of the three members were not made “by and with the Advice andConsent of the Senate.”This does not, however, end the dispute. The Board contends that despite the failure of the President to comply with Article II, Section 2, Clause 2, he none the less validly made theappointments under a provision sometimes referred to as the“Recess Appointments Clause,” which provides that “[t]hePresident shall have Power to fill up all Vacancies that may happen during the Recess of the Senate, by granting Commissions which shall expire at the End of their nextSession.”

    Id.art. II, § 2, cl. 3. Noel Canning contends that the putative recess appointments are invalid and the Recess Appointments Clause is inapplicable because the Senate was not in the recess at the time of the putative appointments and the vacancies did not happen during the recess of the Senate. We consider those issues in turn.

    A. The Meaning of “the Recess”
    Noel Canning contends that the term “the Recess” in the Recess Appointments Clause refers to the intersession recess of the Senate, that is to say, the period between sessions of the Senate when the Senate is by definition not in session and therefore unavailable to receive and act upon nominations from the President. The Board’s position is much less clear. It argues that the alternative appointment procedure created by that Clause is available during intrasession “recesses,” or breaks in the Senate’s business when it is otherwise in a continuing session. The Board never states how short a break is too short,under its theory, to serve as a “recess” for purposes of the Recess Appointments Clause. This merely reflects the Board’s larger problem: it fails to differentiate between “recesses” and the actual constitutional language, “the Recess.”

    It is this difference between the word choice “recess”and “the Recess” that first draws our attention. When interpreting a constitutional provision, we must look to the natural meaning of the text as it would have been understood at the time of the ratification of the Constitution.

    , 128 S. Ct. 2783, 2788 (2008). Then, as now, the word “the” was and is a definite article.

    See 2 SamuelJohnson, A Dictionary of the English Language 2041 (1755)(defining “the” as an “article noting a particular thing”(emphasis added)). Unlike “a” or “an,” that definite article suggests specificity. As a matter of cold, unadorned logic, it makes no sense to adopt the Board’s proposition that when the Framers said “the Recess,” what they really meant was “a recess.” This is not an insignificant distinction. In the end it makes all the difference.Six times the Constitution uses some form of the verb“adjourn” or the noun “adjournment” to refer to breaks in the proceedings of one or both Houses of Congress. Twice, it uses the term “the Recess”: once in the Recess Appointments Clauseand once in the Senate Vacancies Clause, U.S. Const. art. I, § 3,cl. 2. Not only did the Framers use a different word, but none of the “adjournment” usages is preceded by the definite article. All this points to the inescapable conclusion that the Framers intended something specific by the term “the Recess,” and that it was something different than a generic break in proceedings.

    The structure of the Clause is to the same effect. The Clause sets a time limit on recess appointments by providing that those commissions shall expire “at the End of their [theSenate’s] next Session.” Again, the Framers have created adichotomy. The appointment may be made in “the Recess,” but it ends at the end of the next “Session.” The natural interpretation of the Clause is that the Constitution is noting a difference between “the Recess” and the “Session.” Either the Senate is in session, or it is in the recess. If it has broken for three days within an ongoing session, it is not in “the Recess.”

    As with the first issue, we hold that the petitioner’sunderstanding of the constitutional provision is correct, and the Board’s is wrong. The Board had no quorum, and its order is void.
