    Lerner to GOP candidate: We’ll drop charges if you promise never to run again

    According to a report published Wednesday at Illinois Review, Lois Lerner, the embattled IRS official who ran the department that targeted some 500 conservative and Christian organizations seeking tax-exempt status, once told a GOP candidate running against Sen. Dick Durbin, D-Ill., that she would drop all charges against him if he promised never to run for office again.

    Al Salvi, the Illinois Republican who ran against Durbin in 1996, told the Illinois Review in an exclusive interview that when Lerner ran the Enforcement Division of the Federal Election Commission, she made him an offer: “Promise me you will never run for office again, and we’ll drop this case.”

    Not only did Salvi decline her offer, he ran for Illinois Secretary of State in 1998.

    Salvi said he recognized Lerner when he saw her invoke her Fifth Amendment rights.

    “That’s the woman,” he said. “And I didn’t plead the Fifth like she did.”

    During the final weeks of the 1996 campaign, two FEC complaints were filed against Salvi – one by Illinois Democrats about the way he reported a loan he made to himself, and another by the Democratic Senatorial Committee about a reported business donation, Illinios Review said.

    News of the complaint and a personal $1.1 million loan he made to the campaign dominated the news and suffocated his campaign.

    “We couldn’t get our message out because day after day, the media carried story after story about the FEC complaint,” Salvi said. Durbin won the election and Salvi was left to clear his name.

    A federal district court dismissed the case against him in 1999, but the FEC appealed it to the 7th U.S. District Court of Appeals, calling in the FBI to go after him.

    “According to Salvi, two FBI agents unexpectedly visited the Salvis’ home, and interrogated his elderly mother about her $2,000 check to her son’s campaign and where she got ‘that kind of money,’” Illinois Review said.

    The case was finally dismissed in 2000, but Salvi said it was Durbin’s way of getting him out of politics.

    “The judge said to Lerner, ‘Let me get this straight – Mr. Salvi loaning himself money is legal, and you have no complaint against that, is that right?’” Salvi recalled. “Ms. Lerner agreed. Then the judge said, ‘You just don’t like the way his attorneys filled out the report?’ Lerner agreed.”

    Salvi never paid the FEC a dollar in fines or penalties, Illinois Review said, but the four-year-long case cost him a hundred thousand dollars in legal fees.

    Lerner continued her stint at the FEC, going after the Christian Coalition. She later moved to the IRS, where she is now embroiled in a scandal involving the targeting of conservative and Christian organizations.

    Durbin went on to ask the IRS to target Crossroads GPS, a conservative group run by Karl Rove.

    “Salvi says it will be interesting to see how Lois Lerner, Dick Durbin, the FEC, IRS, and Illinois politics intersect as these investigations continue,” the Illinois Review article concluded.

    Obamacare’s Slush Fund Fuels A Broader Lobbying Controversy

    A little-noticed part of President Obama’s Affordable Care Act channels some $12.5 billion into a vaguely defined “Prevention and Public Health Fund” over the next decade–and some of that money is going for everything from massage therapists who offer “calming techniques,” to groups advocating higher state and local taxes on tobacco and soda, and stricter zoning restrictions on fast-food restaurants.

    The program, which is run by the U.S. Department of Health and Human Services (HHS), has raised alarms among congressional critics, who call it a “slush fund,” because the department can spend the money as it sees fit and without going through the congressional appropriations process. The sums involved are vast. By 2022, the department will be able to spend $2 billion per year at its sole discretion. In perpetuity.

    What makes the Prevention and Public Health Fund controversial is its multibillion-dollar size, its unending nature (the fund never expires), and its vague spending mandate: any program designed “to improve health and help restrain the rate of, growth” of health-care costs. That can include anything from “pickleball” (a racquet sport) in Carteret County, N.C. to Zumba (a dance fitness program), kayaking and kickboxing in Waco, TX.

    “It’s totally crazy to give the executive branch $2 billion a year ad infinitum to spend as they wish,” said budget expert Jim Capretta of the conservative Ethics and Public Policy Center. “Congress has the power of the purse, the purpose of which is to insure that the Executive branch is using taxpayer resources as Congress specified.”

    The concerns are as diverse as the critics. The HHS Inspector General, in a 2012 “alert,” was concerned that the payments to third-party groups came dangerously close to taxpayer-funded lobbying. While current law bars lobbying with federal money, Obama administration officials and Republican lawmakers differ on where lawful “education” ends and illicit “lobbying” begins. Nor have federal courts defined “lobbying” for the purposes of this fund. A health and Human Services (HHS) department spokesman denies that any laws were broken and the inspector general is continuing to investigate.

    State Dept: We May Not Comply With Congress’ Benghazi Subpoena

    Is the battle between the State Department and Congress over Benghazi about to escalate? It appears so, after a spokesperson for State suggested the Department may not comply with the Congressional subpoena.

    As reported by Breitbart.com, Congressman Darrell Issa (R-CA) sent a five-page letter to Sate Tuesday explaining why he as chair of the Oversight Committee issued the subpoena and what documents he expects to be delivered by June 7th.

    Asked about the State Department’s response to the letter, Spokesperson Jen Psaki praised the “unprecedented degree of cooperation with Congress” on the issue of Benghazi. Psaki added that the Department is “taking stock” and “determining the next appropriate steps.”

    “You haven’t yet decided whether or not the State Department will be providing the documents that are in the subpoena?” a reporter asked Psaki. “That’s correct,” she responded.

    Partial transcript:

    QUESTION: Yesterday, Chairman Issa sent a letter to Secretary Kerry and issued a subpoena for documents relating to the development of the talking points used by Susan Rice and communications between 10 current and former State officials. … Does the Department intend on complying with the … June 7th deadline for supplying these documents?

    PSAKI: Well, let me just remind everyone … that we have demonstrated … an unprecedented degree of cooperation with Congress on the issue of Benghazi, engaging now in nearly 40 hearings, briefing members of staff and sharing over 25,000 pages of documents.

    But of course, we remain committed, as we have consistently been, to working with Congress, and we are taking stock of this recent subpoena and determining the next appropriate steps.

    QUESTION: Has the Secretary responded?

    PSAKI: No. I just said we’re determining the next appropriate steps.

    QUESTION: So just a quick follow-up to that just for clarity. So when you say you’re determining the next appropriate steps, you haven’t yet decided whether or not the State Department will be providing the documents that are in the subpoena?

    MS. PSAKI: That’s correct. But we have provided, just as a reminder, of course, a hundred pages of documents on the talking points that this is regarding.

    So, it looks like it could be game on! The State Department can hardly be blamed for its “monkey see, monkey do” mentality, can it? Isn’t it merely aping the antics of Barack Obama? If he sees a law he doesn’t like, he ignores it. (See: Defense of Marriage Act, federal immigration laws.) If he submits a bill to Congress and it doesn’t pass, he implements it anyway. (See: Dream Act.) And if Congress gets in his way on anything? He circumvents it via royal edict executive order.

    Yes, it appears that the State Department is simply following the example set by the President of the United States. Go figure.

    FLASHBACK: Agency head visited Bush once in four years

    Scandal: One IRS commissioner visited Obama’s White House 118 times in 2010 and 2011. His successor also dropped in often. But under George W. Bush, the tax chief visited once in four years. Time for an audit.

    As the Washington Examiner noted last weekend, ex-commissioner of the Internal Revenue Service Douglas Shulman went to the White House some 118 times in 2010 and 2011, while Steven Miller, the acting director who took over from Shulman last November, himself made numerous trips there, White House visitor logs show.
    Business as usual for one of the most powerful arms of the federal government, you might think. Not so.
    Mark Everson, who ran the IRS during most of the George W. Bush administration, from 2003 to 2007, apparently visited a single time, grousing that he felt like he had “moved to Siberia” because the tax collection agency was so out of the policy loop.
    The alibi the White House has wedded itself to is that it had to work closely with the IRS to implement ObamaCare. But House Oversight Committee Chairman Darrell Issa, R-Calif., says “it’s hard to believe” the IRS’ abusive targeting of Tea Party and other conservative groups did not enter into the conversations that took place at these meetings, at least “in passing.”

    But the Bush administration actually did some IRS revamping during its tenure, to “provide IRS with the modern tools needed both to deliver first-class customer service to America’s taxpayers and to ensure that compliance programs are administered efficiently,” with one of the major goals being to address “the drop in customer service … over the past several years.”
    Yet that didn’t seem to require the IRS commissioner to scurry to the West Wing more than 100 times, or anything close to it.

    Commentary’s John Steele Gordon points out that the managerial post of IRS commissioner coming over to the White House once a week on average might make sense if President Obama had been planning a big tax code restructuring. But that was not the case, and “Obama’s sole interest in the tax code has been to raise rates on high earners,” Gordon notes.
    Shulman admits he knew by spring 2012 that the IRS was targeting conservative groups.
    So, “Is it really believable that someone who had a Wall Street career before coming to Washington five years ago was so politically naive that he didn’t see the potential for scandal in that information and give the White House a heads-up?” Gordon asks. And that no White House staffer then passed it on to the president?

    Then again, Shulman is the same guy who, with a straight face, answered Congress’ questions about the 118 visits with the alibi that he visited the White House to attend “the Easter Egg Roll, with my kids.”
    That’s a lot of Easter Eggs — but not a lot of credibility.
    There is a lot the American public do not yet know about communications between the White House and IRS. The integrity of free government demands a full, serious investigation.

    OBAMA’S STORY UNRAVELS: Former Bin Laden Bodyguard Claims 9-11 Mastermind Blew Himself Up During Raid

    (CBS-DC) — A former bodyguard for Osama bin Laden is claiming the terror leader blew himself up during the U.S. special forces raid on his Abbotabad compound in Pakistan.

    Nabil Naim Abdel Fattah told Gulf News that Navy SEALs did not kill the al Qaeda leader who planned the Sept. 11, 2001 attacks.

    “U.S. special forces did not kill Osama Bin Laden. He detonated himself to avoid being captured after American forces raided his hiding place in Pakistan in 2011,” Abedel Fattah explained to Gulf News.
